(Herein referred to as “the Academy”)
Membership Agreement
In consideration of the premisses, terms, covenants and conditions contained in the agreement, and other valuable consideration by each party to the other party, the receipt and sufficiency of which You and the Academy acknowledge, You and the Academy agree as follows:
Program and Payments:
Your initial term for membership will be for a term of 1 year, beginning on the date of this signed agreement. As payment for your membership You agree to directly pay to the Academy or its agents, the sum of $___1200__ . After the 1 year your membership will be auto-renewed unless a cancelation request is processed as per the cancelation policy outlined in this document. Your ongoing monthly membership will be $_____199__ and payable monthly starting 1 year from the date of this agreement.
In the case that a payment is not made or is late, I understand that my payment must be made before I can continue to train.
To keep my current rate, after renewal, I understand that after each term, my membership will automatically renew for another term at the same rate and duration using the billing information provided above, until I follow the Cancelation policy of the academy.
Cancellation Policy:
If You choose to cancel your membership, it is required that You submit your cancellation request in writing, either electronically or hard copy and get a signed statement from an official at the academy, acknowledging the receipt of your notice, in order to prove that you did send notice. To terminate Your membership agreement You agree to give 30 days notice. If Your billing date falls inside of your 30 day notice, You understand and agree that you will be charged for that months membership. To cancel You must follow the above procedure. This applies to the ongoing monthly payment after the 1 year PIF (paid in full) has completed. The 1 year PIF is non-transferable and non-refundable.
Freeze Policy:
You may freeze your membership if You are unable to attend the academy for a 1 month period by submitting a freeze/hold request in writing, either electronically or hard copy and get a signed statement from an official at the academy, acknowledging the receipt of your notice. You understand that you are still responsible for the terms of Your agreement and that a freeze only extends the term period and not impact the amount due. The Academy has a maximum freeze of 2 months in 1 month increments within one calendar year. If You need to freeze your membership any longer then You would need to submit a cancellation request and you forfeit your current rate and upon coming back to the academy You will be a new member and subject to the current pricing structures. This applies to the month to month membership once your 1 year PIF is complete.
You may cancel this agreement by midnight of the Academy’s 3rd business day after the date of this agreement. Excluding Sunday or holidays, such cancellation must be in writing either electronically or hard copy and you must receive an acknowledgement of receipt of your notice from an official at the academy. If you miss the initial cancelation period, you may still cancel your membership afterwards by following the cancelation policy above, however any fees collected are non-refundable. If your account goes more than 90 days delinquent, you may be sent to collections for the full outstanding amount. You may cancel your membership if you develop a full disability, which prohibits you from utilizing all portions of the academy, by having bringing a Doctor’s note to an official at the academy. For minor injuries please see the freeze policy above.
Additional Training agreement terms & conditions:
- Failure to attend class does not signify or imply notification to cancel this agreement.
- Member’s failure to continue lessons during the notification or program periods does not relieve the obligation to pay the remaining membership fee balance in full.
- You understand that the schedule is subject to changes, that classes may be cancelled due to special circumstances, you may have to reselect your schedule which may be different depending on availability.
- You assume all responsibility for any costs of collection, including but not limited to reasonable collection agency fees, court costs, reasonable attorney's fees and applicable late charges that may be incurred for default payments.
- Academy officials may make any modifications in the class schedule as deemed necessary. Such modification does not relieve You of your payment obligations under any circumstances.
- It is assumed that member(s) will attend an average of 8 classes per month (unless specified differently herein)
- Academy officials may close the school on national holidays, for the purpose of special events, and a period not exceeding 3 weeks per year for necessary maintenance and other purposes without affecting scheduled tuition payments.
- Academy officials and this acting under its authority reserve the right to use photographs, videotapes, artwork or other likeness of the student for marketing, trade, publishing or any other lawful purpose.
- In consideration of the martial arts training obtained, member agrees not to engage in martial arts teaching practices within a fifty mile radius of the academy, or any other academy associated with the academy officials for a period of 2 years following disassociation with the academy, without written permission.
- Full payment of membership fees does not guarantee Belt certification by academy officials.
- Membership is non-cancellable and non-transferrable except as stated herein.
- Member’s failure to attend scheduled lessons relieves the obligation of the academy to provide lessons after program end date.
- You authorize the use of a disclosed email address for billing purposes and acknowledge that email text may include financial information pertaining to membership.
- As a student of the academy, in the event that you should decide to fight professionally at any time in the future, understand that you must not fight any person without the approval of the academy.
Waiver of Liability
- Member represents that (s)he is in good physical condition, is not suffering from any heart, lung or other bodily ailment and is in all respects physically fit to engage in the martial arts course.
- Member has been advised that strict observance of rules and regulations relative to martial arts self-defense training is mandated and includes the use of protective equipment. The Academy does not warrant that protective equipment will completely eliminate the possibility of accident, injury or death, but will substantially reduce the risk of the accident, injury or death.
- Physical contact will be used by employees of the academy, other students, and authorized individuals as part of the course or instruction. Member has been advised of such fact and gives full consent to any physical contact as may be required or customary to martial arts training.
- In recognition of the possibility of accident, injury or death connected with martial arts training, member waives any right or cause of action of any kind arising as the result of such activity from which an liability may or could accrue to the school, its officers, agents, employees, instructors and/or students.
Consumer Privileges
- This agreement may be canceled for any reason without penalty or further obligation within 3 days from the date of this agreement. Cancelation shall be made in writing, either electronically or hard copy. All money paid by you shall be refunded by the academy within 30 days of receipt of this notice of cancellation. However, the school may retain expenses incurred and the portion of the total price representing the services used and completed based on the hourly rate of $35 per hour. Down payments are non-refundable after the first 3 days.
- If member becomes disabled for at least six months during the membership terms, you have the right to an extension of this agreement. A letter must be submitted to the school from he member’s physician explicitly stating medical condition and estimated time unable to participate in any training program.
- You may cancel this agreement if the member changes residence more than 25 miles from the academy. Cancellation under this section requires written proof of new permanent address. Cancellation is effective the date of move or upon official notification to the academy, whichever is later. A residence investigation will then be conducted.
By signing below, You agree to act responsibly with the techniques that will be taught at the academy. Under no circumstances shall the information learned at the Academy be used outside the academy unless required for self-defense. You pledge to uphold the traditions and honor of the martial arts and the rules and regulations of the academy. You acknowledge that you have read and understood all the terms set forth on this agreement and acknowledge full responsibility to the terms and conditions stated herein as required for membership.
